This Privacy Policy explains how ELIOS TECH S.A., a corporation incorporated and existing under the laws of the Republic of Panama (registration number: 155782562), along with our affiliates and subsidiaries ("Elios," "we," "us," or "our") collects, uses, shares, retains, and protects information about you when you use the Services. For Personal Information that Elios determines how and why to process, Elios is the controller or equivalent responsible party under applicable privacy laws.
Capitalized terms used but not defined in this Privacy Policy have the meanings given to them in the Elios Terms of Service. This Privacy Policy is incorporated into and forms part of the Terms of Service.
This Privacy Policy applies to the Elios website, mobile applications, waitlist, marketing pages, any web app that links to this Privacy Policy, support channels, smart-account interface, card-access features, fiat on-ramp and off-ramp flows, selected DeFi vault interface, Rewards and referral features, and any other Elios product or feature that links to this Privacy Policy (collectively, the "Services").
Elios is a self-custodial stablecoin application that enables users to hold supported stablecoins in user-controlled smart accounts, send and receive supported assets, access the Elios Card through third-party providers, use fiat rails through licensed partners, access supported DeFi vaults, and participate in Rewards features.
Some features are provided by or depend on third parties. These may include Verification Providers, Card Program Providers, Financial Services Providers, fiat on-ramp and off-ramp providers, payment processors, card networks, app stores, blockchain networks, bridge protocols, DeFi protocols, infrastructure providers, analytics providers, and other service providers. Those third parties may collect and process information under their own terms and privacy notices. This Privacy Policy explains Elios-controlled processing and the information Elios may receive or share in connection with those features; it does not replace applicable third-party cardholder agreements, card-provider terms, fiat on-ramp/off-ramp provider terms, or third-party privacy notices.
In this Privacy Policy, "Personal Information" means information that identifies, relates to, describes, can reasonably be associated with, or could reasonably be linked to an individual or household, depending on applicable law. Wallet addresses, smart-account addresses, device identifiers, transaction metadata, and pseudonymous identifiers may be Personal Information where they can reasonably be linked to you.
Elios is designed to be non-custodial. You own and control your Elios Smart Account. Elios does not hold, custody, possess, or control your Digital Assets and does not collect, store, access, request, transmit, or back up your private keys or seed phrases in a form that Elios can access or decrypt. Elios will never ask you to provide your private key or seed phrase.
Elios also does not collect API private keys. If future features involve API credentials or tokens, they will be described separately before use and should not be confused with wallet private keys or seed phrases.
Depending on the feature, Elios may process authentication-related information, such as login events, passkey public keys, authentication status, device security signals, account recovery status, or other metadata needed to operate and secure the Services. Elios is not intended to receive your private passkeys, private keys, seed phrases, or recovery phrases.
If Elios offers encrypted client-side cloud backup, backup material is intended to be encrypted before it is stored with the applicable cloud or infrastructure provider, and Elios and its vendors are not intended to have the information needed to decrypt or access the underlying private keys. Elios may process limited metadata about the backup feature, such as whether backup is enabled, timestamps, diagnostic logs, and security events.
