1.1 Agreement
These Terms of Service, together with any documents incorporated by reference (collectively, these “Terms”), constitute a binding legal agreement between you and ELIOS TECH S.A., a corporation incorporated and existing under the laws of the Republic of Panama (registration number: 155782562) (“Elios,” “we,” “us,” or “our”) governing your access to and use of the Elios website, mobile applications, smart-account interface, card interface, supported stablecoin transfer and conversion features, supported DeFi vault interface, rewards features, and any other products, services, content, tools, functionality, or features that we make available from time to time (collectively, the “Services”).
1.2 Acceptance
By accessing, browsing, downloading, installing, registering for, signing into, or otherwise using any part of the Services, or by clicking “I agree,” “I accept,” or a similar button or checkbox, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.
1.3 Privacy Policy
Our Privacy Policy, available at https://about.eliospay.com/privacy, explains how Elios collects, uses, shares, and protects information about you. The Privacy Policy is incorporated into these Terms by reference. By using the Services, you acknowledge our Privacy Policy.
1.4 Additional and third-party terms
Certain features are provided by, rely on, or are subject to terms, disclosures, limits, fees, policies, or agreements of third parties (collectively, “Additional Terms”). For example, your use of the Elios Card is subject to the Elios Cardholder Agreement (US) or Elios Cardholder Agreement (International), as applicable, available at https://about.eliospay.com/. If there is a conflict between these Terms and applicable Additional Terms regarding a third-party service, the Additional Terms govern that third-party service.
1.5 Changes to these Terms
We may modify these Terms from time to time. If we make material changes, we will use reasonable means to notify you, such as posting the updated Terms through the Services, updating the “Last updated” date, sending an email, or providing in-app notice. Your continued use of the Services after the updated Terms become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.
2.1 Definitions
“Account” means the Elios account you create to access some or all of the Services.
“Applicable Law” means all laws, regulations, rules, sanctions, orders, licensing requirements, guidance having the force of law, payment network rules, and other legal or regulatory requirements that apply to you, Elios, the Services, or any third-party provider.
“App” means the Elios mobile application for iOS or Android, including updates, modifications, and enhancements.
“Blockchain” means a distributed ledger, blockchain network, layer 1 network, layer 2 network, sidechain, or other cryptographic network supported or referenced by the Services.
“Card Program Provider” means any third-party card issuer, program manager, payment processor, payment network, bank, financial institution, lender, servicer, or other provider involved in issuing, supporting, processing, servicing, managing, or making available the Elios Card.
